TULSA - Former Tulsa County Reserve Deputy Robert Bates was scheduled to appear in court Tuesday, but no hearing took place.
2 Works for You reporter Gitzel Puente spoke with Bates' attorney, Clark Brewster, who said there wasn't a hearing because the date was set before the second judge recused herself from the case.
Judges James Caputo and Sharon Holmes previously removed themselves. Judge Bill Musseman has the case now.
Bates faces a second-degree manslaughter charge for shooting and killing a suspect during an undercover operation last April.
Bates claims he mistook his gun for his Taser.
